00:00:00Genocide of?
00:00:01>> The naga people in northeast india.
00:00:02>> Judge Judy: Have you been there before?
00:00:04>> Yes, I have.
00:00:05>> Judge Judy: How many times?
00:00:06>> Once before.
00:00:07>> Judge Judy: When?
00:00:08>> 2005.
00:00:09>> Judge Judy: And when did you meet ms. balin?
00:00:11>> I met her on january 21, 2009, the day after the inauguration.
00:00:17>> Judge Judy: What is your profession?
00:00:19>> I'm a filmmaker -- an independent filmmaker.
00:00:21>> Judge Judy: Have you ever made anything that was commercially successful?
00:00:25>> Yes.
00:00:25Yes, I've produced five feature films since the age of 19.
00:00:28>> Judge Judy: Is that how you make a living?
00:00:31>> You could call it a living, yes.
00:00:33[ Laughter ] >> Judge Judy: No.
00:00:35I'm asking you what you call it.
00:00:36>> It's not quite enough of a living, but it is my sole source of income.
00:00:39>> Judge Judy: It is your sole source of income.
00:00:41>> Yes.
00:00:42>> Judge Judy: Okay.
00:00:43Tell me about the trip to india.
00:00:44>> We were planning to go on FEBRUARY 8th -- FROM LIKE February 8th to the 17th.
00:00:48>> Judge Judy: And what arrangements did you make with her for payment?
00:00:51>> That I would just pay for her air ticket and visas.
00:00:53>> Judge Judy: What about her expenses?
00:00:55>> There would be no additional expenses.
00:00:56>> Judge Judy: Well, how was she gonna live there?
00:00:59>> Oh, the nagas would pay for everything -- the hotel, food, and everything.
00:01:02>> Judge Judy: And all the expenses.
00:01:05Go ahead.
00:01:06>> All of us got our visas, except for one gentleman that she was bringing to the table.
00:01:10>> Judge Judy: How much did it cost to get your visa?
00:01:12>> $73 A person.
00:01:13>> Judge Judy: Okay.
00:01:14>> So she had to fly up from to san francisco because there is no consulate that could do it in such a short amount of time.
00:01:21So she flew up to san francisco, and then she called me from san francisco subway station and said she lost her wallet and therefore I would need to pay her some more money.
00:01:29>> Judge Judy: Well, how much money had you given her to fly to san francisco?
00:01:33>> $350.
00:01:34>> Judge Judy: Go ahead.
00:01:36>> And then two days before we were to leave, I got a call from the indian consulate that my visa was revoked.
00:01:43Sorry.
00:01:43Prior to that.
00:01:45The minute I got the visas, i purchased tickets online.
00:01:48And this is how I travel.
00:01:50You can see proof that I got my visa and all the travel that I've done.
00:01:53>> Judge Judy: Your visa was revoked, and you got the airline ticket, and the airline ticket was nonrefundable.
00:01:58>> I did not realize that, but I've never canceled a trip before in my whole life.
00:02:01>> Judge Judy: You say that the airline ticket was nonrefundable.
00:02:04>> That's what they told me.
00:02:05>> Judge Judy: Fine.
00:02:06>> If I may, your honor?
00:02:07>> Judge Judy: Just a second.
00:02:08How much was her ticket?
00:02:09>> $1,114.40.
00:02:12>> Judge Judy: Okay.
00:02:13When did you cancel the trip?
00:02:15>> Well, the minute we heard our visas were revoked.
00:02:17>> Judge Judy: What date?
00:02:19>> FEBRUARY 6th.
00:02:19>> Judge Judy: And when did you call the defendant and let her know that the trip was going -- >> the same day.
00:02:24>> Judge Judy: Okay.
00:02:24And what did you tell her to do with her ticket?
00:02:27>> I told her I was fighting the case on the basis of frustration of purpose.
00:02:31Our mission was to go there, and we were not able to go by a third, unknown entity of having our visas revoked -- that I was gonna fight it.
00:02:38>> Judge Judy: I understand that you were fighting it.
00:02:40What happened with your ticket, by the way?
00:02:42>> Well, in my case, my father had three seizures at the same time.
00:02:45>> Judge Judy: What happened with your ticket?
00:02:48>> I was refunded my ticket on the basis of my father's illness.
00:02:51>> Judge Judy: But that's not the reason that you canceled the ticket.
00:02:54>> No.
00:02:54I canceled it based on revoked visa.
00:02:56>> Judge Judy: collins, are you telling me that you provided medical documentation about your father's seizures to the airlines and based on that they refunded your money?
00:03:04>> Yes.
00:03:04>> Judge Judy: Well, then that was false.
00:03:06That's what you're telling me.
00:03:08I mean, that wasn't the reason that you weren't going.
00:03:10>> No.
00:03:11Both reasons.
00:03:11I told them it was a revoked visa and it was also my father.
00:03:14>> Judge Judy: When did you turn in your ticket?
00:03:16>> When did I convert my ticket to use it?
00:03:18SHORTLY BEFORE APRIL 3rd.
00:03:20>> Judge Judy: Okay.
00:03:21Now, the trip was canceled in february, correct?
00:03:24>> Yes.
00:03:24>> Judge Judy: Between february and april, what communication collins about returning that ticket to you?
00:03:32>> About somewhere up to 30 days from the cancellation of the collins called me to notify me that continental airlines had denied her claim, that the tickets were nonrefundable, that she was going to have to litigate against the indian government to be reimbursed because she had gone through all the procedures with continental and that the ticket was only usable in my name, that she would not be reimbursed, and that the ticket was only good for one year.
00:04:03So, could I use the ticket, she suggested, and pay her the difference so that she could be reimbursed?
00:04:10I was very clear during that phone conversation that, as an independent filmmaker, I was not in the position to take a trip and reimburse her and that i wouldn't use the ticket.
00:04:20>> Judge Judy: How was she to be reimbursed with regard to the time that she'd spent in san francisco?
00:04:25>> We never discussed that because we didn't even know that was gonna happen.
00:04:29>> Judge Judy: So that at least in part, you would say, collins, the payment that the defendant was to recoup as a result of this enterprise was she was going to get a free trip to someplace and have all of her expenses paid and have the ability to participate in the making of this documentary.
00:04:50>> Only in nagaland.
00:04:51>> Judge Judy: I understand that.
00:04:53>> This whole thing about coming to san francisco came out of the blue.
00:04:56>> Well, she had to go there.
00:04:57You explained that to me.
00:04:58She couldn't get it in los angeles.
00:05:00>> I know, but I'm saying -- >> Judge Judy: She couldn't get it in los angeles.
00:05:03She had to travel to san francisco in furtherance of the project.
00:05:07>> Correct.
00:05:08But I'm saying -- >> Judge Judy: collins, what happened was -- and I gather, balin, what you did was you converted the ticket and you used it for travel someplace else.
00:05:17>> At her suggestion.
00:05:18>> Judge Judy: Well, what she wanted you to do was see if you could use it and give her money.
00:05:22And you said, "i'm not doing " >> and she said, "then use it anyway because it's void in one " >> Judge Judy: Yeah.
00:05:29She wouldn't have gotten back her money from the airlines if she hadn't submitted a medical reason of her father's illness in order to get it back, and she certainly couldn't use that for you.
00:05:38>> And I confirmed with -- >> Judge Judy: Just a second.
00:05:40How many other airline tickets did you purchase, ms. collins?
00:05:43>> I purchased four.
00:05:44>> Judge Judy: Were you able to get any other money back other than for your ticket?
00:05:48>> Not yet.
00:05:49I'm still in the process.
00:05:50>> Judge Judy: The answer is " >> I'm in the process of -- >> Judge Judy: The answer is "no," correct?
00:05:54>> I'm still working on it.
00:05:55>> Judge Judy: The answer is " >> no, for now.
00:05:58>> Judge Judy: Well, "no, for " the only reason you got yours back is because you lied to the airlines.
00:06:03>> I did not lie.
00:06:04>> Judge Judy: Yes, you did.
00:06:05>> I can prove that my father -- >> Judge Judy: Absolutely.
00:06:08Stop playing.
00:06:09>> I can prove my father's medical.
00:06:11>> Judge Judy: Listen to me.
00:06:12>> Can you take this up to her?
00:06:14>> Judge Judy: No, he can't.
00:06:15Listen to me very carefully!
00:06:17Look at me!
00:06:18>> Announcer: "Judge judy" continues in a moment.
00:06:21>> Judge Judy: Okay, but you owe her the $500.
00:06:23>> It was to be deducted from my salary.
00:06:25>> No.
00:06:25>> Judge Judy: You owe her the $500.
00:06:27Stop it.
00:06:28You're embarrassing yourself.
00:06:29>> Announcer:..
00:06:30>> Judge Judy: You're responsible for the lost money.
00:06:32>> No, I'm not, your honor.
00:06:33>> Judge Judy: I don't care whether you say you are or whether you say you aren't.
00:06:36That's why you're here, sir.
00:06:37That's why I went to law school and you are unemployed.
00:06:40[ Laughter ] know a budget.
00:07:45That's why right now I'm offering the Jumbo Deal.
00:07:47It's a Jumbo Jack, two of my classic Tacos, fries and a drink for only $3.49.
00:07:52Man that's a lot of food.
00:07:55It'll fill you up and let you save money for important things- -like school supplies.
00:08:13Hchchchchc >> Announcer: Real cases.
00:08:17Real people.
00:08:18" grace collins says former business associate melissa balin owes for a trip to india and for unpaid loans.
00:08:27Melissa says the trip and money were compensation for her work.
00:08:31>> Judge Judy: You tried to get it back based upon the fact that your visa was revoked.
00:08:36That's what you told me first.
00:08:37You couldn't.
00:08:38And then somebody said to you, "well, see if you can use a medical excuse, because if a close family member is ill --" >> it all happened at the same time.
00:08:48>> Judge Judy: collins, i tell you what we do.
00:08:51I'm dismissing your case with regard to the airline ticket without prejudice.
00:08:55If you are successful in recouping from the airlines money for the other two tickets that you purchased, you have leave to come back here.
00:09:02I don't think that that's going to happen.
00:09:04Did you sue the others?
00:09:05>> The day on the -- >> Judge Judy: Did you sue -- did you sue?
00:09:09You tried frustration of purpose.
00:09:10It didn't work.
00:09:11>> No, I have not.
00:09:12>> Judge Judy: Well, then why did you use a different reason for yourself than you want to use for everybody else?
00:09:18>> Well, that also happened at exactly the same time, which you can see.
00:09:21>> Judge Judy: Did you hear my answer?
00:09:23I'm not looking at it.
00:09:24It's irrelevant.
00:09:25>> It's very relevant if your father had three seizures.
00:09:28>> Judge Judy: It's irrelevant to your claim.
00:09:31I just told you, if you are successful in suing for the return of the money for the other two tickets, you have leave to come back against this defendant.
00:09:42I don't know if the decision will be the same or different, but you have leave to come back.
00:09:46Now let's get to the money that you allegedly loaned her.
00:09:50How much money did you give her in total?
00:09:53>> I gave her an extra $146.
00:09:55>> Judge Judy: $146 You gave her twice?
00:09:58>> Correct.
00:09:58>> Judge Judy: Is that correct?
00:10:00>> It was the initial $350 and an additional $146.
00:10:04>> Judge Judy: Okay.
00:10:05And the $146 you either lost or was stolen.
00:10:08Is that right?
00:10:08>> Well -- >> Judge Judy: That's either a yes or a no.
00:10:10>> Yes.
00:10:11>> Judge Judy: Okay.
00:10:11So that you owe her, $146, 'cause she gave that to you once.
00:10:15She doesn't have to give it to you twice.
00:10:17>> But my trip was extended.
00:10:18>> Judge Judy: What about the other money?
00:10:20>> $500, Which she clearly says here that she loaned me -- that I loaned her and that she's gonna give it back to me.
00:10:25>> Judge Judy: I'd like to see that.
00:10:27>> And can I present, as well, the e-mail -- >> Judge Judy: Shh, shh, shh.
00:10:37Fine.
00:10:37So I have here an indication that you acknowledged this $500 as a loan that she made to you, and you say, "since we will not be working together on this project, I will get you the $500 that you loaned me as soon as possible.
00:10:50I told you at the time that i didn't know when I could get it back to you, and you said not to worry.
00:10:55Unfortunately, I still do not have it, and you are right about my personal finances, so I will focus on getting a job to pay " >> and the sentence prior to that indicates it was always intended that I would donate my time to get the project off the ground, but the intention was to raise financing for the short documentary and that I would receive a consulting fee for that and that would be deducted.
00:11:16>> Judge Judy: I understand that, but that never happened.
00:11:19>> She canceled the film.
00:11:20>> Judge Judy: No.
00:11:21She didn't cancel the film.
00:11:23The film was canceled.
00:11:24>> The trip to india was canceled, but I was still working for her after the trip was canceled.
00:11:29>> Judge Judy: You want to show me somewhere where you say, "i don't owe you this $500"?
00:11:35Is that what you want to show me?
00:11:36>> Yes.
00:11:37>> Judge Judy: Where does it say that?
00:11:38>> Further down in the e-mail.
00:11:40The second paragraph.
00:11:41"I will not be reimbursing you for any of these costs now or in " >> Judge Judy: No, no, no, no, no, no, no.
00:11:47"The trip was canceled.
00:11:48I will not be reimbursing you for any of those costs now or in the future.
00:11:52In turn, I will not be billing you for any of my time or for the week I lost trying to " okay, but you owe her the $500.
00:12:01>> It was to be deducted from my salary.
00:12:03>> No.
00:12:03>> Judge Judy: You owe her the $500.
00:12:05Stop it.
00:12:05You're embarrassing yourself.
00:12:07Anything else, ms. collins?
00:12:08>> Yeah, there's more in there.
00:12:09>> Judge Judy: What?
00:12:10>> More references that that was just a loan.
00:12:12>> Judge Judy: I acknowledge that that was a loan.
00:12:15>> Okay.
00:12:15>> Can I submit, your honor, that my visa was not revoked?
00:12:18>> Judge Judy: I don't care!
00:12:19>> Okay.
00:12:20>> Judge Judy: I don't care.
00:12:21>> There's no way she could go in to nagaland.
00:12:23Nobody can go as a single person there.
00:12:25>> Judge Judy: Listen to me, madam.
00:12:28You have my answer with regard to the airplane ticket.
00:12:32You were able to get yours reimbursed, whatever way you chose to get yours reimbursed.
00:12:37Don't show me about your father!
00:12:39If what you say to me is you were the leader of this troupe, and as leader of the troupe, you couldn't go because of your father's illness, then you should have been able to get the other people's money back on the other two tickets that you purchased, right?
00:12:54But you didn't, and you can't get hers.
00:12:57>> Announcer: "Judge judy" continues in a moment.
00:12:59..
00:13:00>> He's got five kids, and he doesn't support any of them.
00:13:03>> Judge Judy: He had three before he had two with you?
00:13:05>> Yes.
00:13:06>> Judge Judy: You should have had a clue.
00:13:08>> Yes, I should have.
00:13:10>> Announcer: Closed captioning ..

00:15:44ShShShShShShShSh >> Announcer: Real cases.
00:15:48Real people.
00:15:49" grace collins says former business associate melissa balin owes for a trip to india and for unpaid loans.
00:15:58Melissa says the trip and money were compensation for her work.
00:16:01>> Judge Judy: I told you, you get the airlines to reimburse the other two, come back, and maybe we'll talk.
00:16:07Right now all she owes you is $646.
00:16:11Judgment for the plaintiff.
00:16:12That's all.
00:16:12>> Byrd: Parties are excused.
00:16:14You may step out.
00:16:16>> Well, it really fell apart when I started receiving ..
00:16:19>> There were no threatening phone calls.
00:16:21..That I was committing theft and fraud for using the ticket in the first place.
00:16:26>> I had one legal person call.
00:16:27>> I'm glad that my name was cleared in terms of not having committed fraud or theft.
00:16:32>> And then we served her appropriately.
00:16:34>> I think sometimes, you know, work done is never wasted and you have to just move forward.
00:16:38>> Announcer: And now the next case.
00:16:40>> Byrd: All parties in the MATTER OF MURI vs. SIMMONS, STEP Forward, please.
00:16:45>> Announcer: 23-Year-old nico muri is suing her ex-boyfriend, shaun simmons, for an unpaid loan, daycare costs, and harassment.
00:16:54>> Judge Judy: muri, the defendant is your former boyfriend and, quite foolishly on your part, you made two children with him.
00:17:00That is probably after you already knew that he had, according to you, a serious gambling problem.
00:17:06It is your claim that he forced you to take out a loan, that the loan waso be used to pay bills, that you claim that he gambled the money away.
00:17:15He says he did not.
00:17:16He saiaid it was either lost or stolen.
00:17:18You also claim that he owes you money because he said he would pay for the children's day care or at least half of it and he didn't and that he has been threatening you.
00:17:28>> Yes.
00:17:28>> Judge Judy: So you want to be compensated for that, too.
00:17:31>> Yes.
00:17:31>> Judge Judy: What was the loan for, mr. simmons?
00:17:33>> It was a title loan on her vehicle, a 2002 ford explorer, for our rent.
00:17:37>> Judge Judy: And when the loan was taken out, the check was cashed, and who took the money?
00:17:42>> I did.
00:17:42>> Judge Judy: And what did you do with it?
00:17:44>> Well, we left from where we goe loan, went back home.
00:17:48Then, the next day, I went and got a haircut at the local wal-mart.
00:17:51I had like $974 on me.
00:17:53Paid for my haircut, went to arby's, ordered some food, and went to pay for my food.
00:17:57Realized I didn't have my wallet.
00:17:58>> Judge Judy: So you either lost your wallet or it was stolen.
00:18:01>> Correct.
00:18:02>> Judge Judy: Where's the police report?
00:18:03>> There is no police report.
00:18:04>> Judge Judy: I don't believe you.
00:18:06>> That's your choice, your honor.
00:18:07I mean, that's the truth.
00:18:08>> Judge Judy: That's my right, because anybody who has a wallet stolen or lost and that's their rent money, they file a police report.
00:18:17>> Like I said, if you let me finish -- >> Judge Judy: Show me a report from -- >> I then went back to wal-mart.
00:18:22I then went back to wal-mart.
00:18:24Customer service had my wallet.
00:18:25There was no money in my wallet.
00:18:27>> Judge Judy: Show me the report.
00:18:29>> What report would there be?
00:18:30>> Judge Judy: From wal-mart.
00:18:31>> Your honor, that night -- >> Judge Judy: Shh!
00:18:38[ Laughter ] there would be a police report that you were the victim of theft.
00:18:43Even if that were not the case, let's say you left your wallet on the counter where you got your haircut.

00:11:01>> [ Sarcastically ] FOR ONLY Knowing him two months, I would just give him $1,000.

00:11:08Got tired of dragging him around.
00:11:10" you went down, you put $1,000 on the account.
00:11:14The only problem that I have with your story, sir, is that somehow miss carmichael got your banking information.
00:11:20You want to tell me how she got your banking information, sir?
00:11:24>> I gave her a blank check in december.
00:11:28>> Judge Judy: What for?
00:11:29>> I was gonna pay her back a little bit of the money that she paid to get my car back.
00:11:33>> Judge Judy: Now we got it.
00:11:35So you gave her a blank check.
00:11:36What did you give her the blank check for?
00:11:39>> She was gonna pay for it online, and she kept my bank account information.
00:11:42I told her not to keep the check.
00:11:44>> Judge Judy: Just one second.
00:11:46Stand up.
00:11:46Now you're not laughing.
00:11:47>> [ Laughs ] >> Judge Judy: Take your hands off your hips.

00:12:05You gave her the blank check so that she could pay herself a little bit of the money that she put down towards your car that she had given you as a gift.
00:12:16>> Correct.
00:12:17>> Judge Judy: Why did you do that, sir?
00:12:20>> I guess it was a dumb idea.

00:12:30Dumb ideas come from people who have dumb brains.
00:12:33 [ laughs ] >> Judge Judy: So she did, in fact, pay herself some of the money that you allege she gave as a gift?
00:12:40>> Mm-hmm.
00:12:41>> Judge Judy: When did you change your mind?
00:12:43>> When I decided that we weren't gonna be together anymore.
00:12:47She was trying to be too serious, and I tried to get out of it.
00:12:51I didn't want to be anything to do with her.

00:16:35The linchpin of this case is when you gave her the check in order for her to repay herself some of the money that you claim was a gift.
00:16:41And there was no reason for you to repay her money that was a gift unless it was, in fact, a loan.
00:16:45She had no right to take all the money out of the account because that's stealing.

00:17:46Are you expecting another child?
00:17:47>> Yes.
00:17:48>> Judge Judy: And you are now separated.
00:17:50>> Yes, we are.
00:17:51>> Judge Judy: It is your claim that when you filed tax returns last year, you were entitled to a refund, that the refund check came, the refund check was in both your names, and you went to the bank together, they cashed the check, and she took all the money and ran out of the bank and refused to give you your half.
00:18:09>> Correct.
00:18:10>> Judge Judy: Miss thomas says that you separated, you left her in a state of substantial economic difficulty, that you haven't paid any support for your child, that she really needed this money, and she offered you some small amount, but she's certainly not giving you half.
00:18:28>> Yes, your honor.
00:18:29>> Judge Judy: When were you married?
00:18:31>> Never was married.

00:18:35>> We have been together for 12 years.

00:19:19As long as we were in the same household, they allowed us to do it.
00:19:23>> Judge Judy: Before I continue with this case, I need some professional advice, so I am going to call my trusted accountant and find out, before I even continue with this, if there's something that I am not getting.

00:20:03Larry, I'm in the middle of doing a case, and I need some professional advice from you.
00:20:09Listen, I have two people before me who are single, but they live together.
00:20:14Is there anything in the tax code that permits them to file joint tax returns?
00:20:19Okay.
00:20:20So these people file jointly, and they got a refund.
00:20:25It was incorrect.

00:24:18>> Judge Judy: Miss thomas, unless you want to get arrested by the feds, you have to return the refund.
00:24:26Then each of you has to file an amended tax return for last year -- probably for the last three years.
00:24:34And each of you has to claim only the income that you had during the year, and each of you will get whatever refund you're entitled to.
00:24:43Probably, there will be a write-off against the penalties you will be charged for filing illegal tax returns, because there is absolutely nothing in the tax code that permits you -- two people living together, not married -- to file joint tax returns.

00:25:31So I'm telling you, you better get some good advice, because i have a very, very smart accountant, and he tells me that you best file an amended return, return this money immediately with your amended return, filing single head of household, if that's what you are.
